{"id":1203,"date":"2023-12-01T08:34:11","date_gmt":"2023-12-01T07:34:11","guid":{"rendered":"https:\/\/www.bdtravnickova.cz\/?page_id=1203"},"modified":"2023-12-01T09:18:01","modified_gmt":"2023-12-01T08:18:01","slug":"smernice-c-01-2007-o-provadeni-oprav-v-bytech","status":"publish","type":"page","link":"https:\/\/www.bdtravnickova.cz\/?page_id=1203","title":{"rendered":"Sm\u011brnice \u010d. 01\/2007 o prov\u00e1d\u011bn\u00ed oprav byt\u016f"},"content":{"rendered":"<h2><span style=\"text-decoration: underline;\">Sm\u011brnice \u010d. 01\/2007 o prov\u00e1d\u011bn\u00ed oprav v bytech<\/span><\/h2>\n<h3>I.\u00a0\u00a0\u00a0\u00a0 \u00davodn\u00ed ustanoven\u00ed<\/h3>\n<ol>\n<li style=\"text-align: justify;\">P\u0159edstavenstvo BD vyd\u00e1v\u00e1 v souladu s \u010dl\u00e1nkem 13, bodem 2, stanov BD sm\u011brnici o prov\u00e1d\u011bn\u00ed oprav v bytech a spole\u010dn\u00fdch \u010d\u00e1stech dom\u016f, kter\u00e9 u\u017e\u00edv\u00e1 u\u017eivatel nebo vlastn\u00edk na z\u00e1klad\u011b u\u017e\u00edvac\u00edho nebo vlastnick\u00e9ho pr\u00e1va k bytu v domech, kter\u00e9 jsou ve vlastnictv\u00ed, spoluvlastnictv\u00ed nebo spr\u00e1v\u011b BD.<\/li>\n<li style=\"text-align: justify;\">Sm\u011brnice upravuje postup p\u0159i prov\u00e1d\u011bn\u00ed nejr\u016fzn\u011bj\u0161\u00edch druh\u016f oprav.<\/li>\n<\/ol>\n<h3>II.\u00a0\u00a0\u00a0 Vymezen\u00ed pojm\u016f, pr\u00e1v a odpov\u011bdnost\u00ed<\/h3>\n<ol>\n<li style=\"text-align: justify;\">BD jako vlastn\u00edk a\u00a0 spr\u00e1vce bytov\u00fdch dom\u016f odpov\u00edd\u00e1 za dodr\u017eov\u00e1n\u00ed obecn\u011b platn\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f v oblasti spr\u00e1vy bytov\u00e9ho fondu.<\/li>\n<li style=\"text-align: justify;\">Z v\u00fdkonu spr\u00e1vy vypl\u00fdv\u00e1 BD odpov\u011bdnost za zaji\u0161t\u011bn\u00ed nutn\u00fdch oprav a za zaji\u0161t\u011bn\u00ed pot\u0159ebn\u00fdch finan\u010dn\u00edch prost\u0159edk\u016f pro jejich realizaci.<\/li>\n<li style=\"text-align: justify;\">Pro \u00fa\u010dely t\u00e9to sm\u011brnice se opravami rozum\u00ed \u010dinnosti:\n<ul>\n<li style=\"text-align: justify;\"><strong>Odstran\u011bn\u00ed<\/strong> \u010d\u00e1ste\u010dn\u00e9ho fyzick\u00e9ho opot\u0159eben\u00ed nebo po\u0161kozen\u00ed majetku za \u00fa\u010delem uveden\u00ed do p\u0159edchoz\u00edho nebo provozuschopn\u00e9ho stavu.<\/li>\n<li style=\"text-align: justify;\"><strong>B\u011b\u017enou \u00fadr\u017ebou<\/strong> jsou \u010dinnosti, kter\u00e9 se prov\u00e1d\u011bj\u00ed obvykle p\u0159i del\u0161\u00edm u\u017e\u00edv\u00e1n\u00ed bytu (\u00a7 6 na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 258\/1995 Sb.- p\u0159\u00edloha \u010d. 1).<\/li>\n<li style=\"text-align: justify;\"><strong>Drobn\u00e9 opravy bytu<\/strong> a jeho vnit\u0159n\u00edho vybaven\u00ed jsou definov\u00e1ny v ustanoven\u00ed \u00a7 5 na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 258\/1995 Sb.- p\u0159\u00edloha \u010d. 1.<\/li>\n<li style=\"text-align: justify;\"><strong>Technick\u00e9 zhodnocen\u00ed<\/strong> &#8211; proveden\u00ed stavebn\u00ed \u00fapravy, rekonstrukce \u010di modernizace v byt\u011b, vyu\u017e\u00edvaj\u00edc\u00ed nov\u00e9 technologie, zvy\u0161uj\u00edc\u00ed komfort bydlen\u00ed, bezpe\u010dnost u\u017eivatel\u016f, \u00faspory energi\u00ed nebo odstran\u011bn\u00ed vad, kter\u00e9 by mohly v\u00e9st k havarijn\u00edm stav\u016fm.<\/li>\n<li style=\"text-align: justify;\"><em>Rekonstrukce<\/em> &#8211; z\u00e1sah do majetku, kter\u00fd m\u00e1 za n\u00e1sledek zm\u011bnu jeho \u00fa\u010delu nebo technick\u00fdch parametr\u016f.<\/li>\n<li style=\"text-align: justify;\"><em>Modernizace<\/em> &#8211; roz\u0161\u00ed\u0159en\u00ed vybavenosti nebo pou\u017eitelnosti majetku. Funk\u010dn\u00ed d\u00edly a \u010d\u00e1sti se nahrazuj\u00ed nov\u00fdmi, modern\u011bj\u0161\u00edmi, aby se odstranily n\u00e1sledky opot\u0159eben\u00ed, zv\u00fd\u0161ila se vybavenost, p\u0159\u00edpadn\u011b vyu\u017eitelnost stavby.<\/li>\n<li style=\"text-align: justify;\"><em>Stavebn\u00ed \u00fapravy<\/em> &#8211; zm\u011bny dokon\u010den\u00fdch staveb, p\u0159i nich\u017e se zachov\u00e1vaj\u00ed vn\u011bj\u0161\u00ed p\u016fdorysn\u00e9 i v\u00fd\u0161kov\u00e9 ohrani\u010den\u00ed stavby.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<ol style=\"text-align: justify;\" start=\"4\">\n<li>U\u017eivatel bytu (\u010dlen-n\u00e1jemce dru\u017estevn\u00edho bytu) odpov\u00edd\u00e1 za prov\u00e1d\u011bn\u00ed pot\u0159ebn\u00e9 \u00fadr\u017eby a drobn\u00fdch oprav, ur\u010den\u00fdch na\u0159\u00edzen\u00edm vl\u00e1dy \u010d. 258\/1995 Sb. a za prov\u00e1d\u011bn\u00ed oprav dle t\u00e9to sm\u011brnice.<\/li>\n<li>U\u017eivatel a vlastn\u00edk je povinen zp\u0159\u00edstupnit byt k realizaci oprav v byt\u011b, vypl\u00fdvaj\u00edc\u00edch z obecn\u011b platn\u00fdch pr\u00e1vn\u00edch p\u0159edpis\u016f.\u00a0 Tuto odpov\u011bdnost nese i v p\u0159\u00edpad\u011b, kdy byt do\u010dasn\u011b u\u017e\u00edv\u00e1\u00a0 podn\u00e1jemn\u00edk.<\/li>\n<li>P\u0159edstavenstvo BD m\u00e1 pr\u00e1vo uplat\u0148ovat sv\u00e9 p\u0159ipom\u00ednky k prov\u00e1d\u011bn\u00ed oprav v bytech.<\/li>\n<\/ol>\n<h3>III.\u00a0 Postup p\u0159i prov\u00e1d\u011bn\u00ed oprav v byt\u011b<\/h3>\n<ol>\n<li style=\"text-align: justify;\">Opravu v bytech a s\u00edt\u00edch, bytem proch\u00e1zej\u00edc\u00edch, prov\u00e1d\u00ed nebo zaji\u0161\u0165uje ka\u017ed\u00fd u\u017eivatel a vlastn\u00edk samostatn\u011b.<\/li>\n<li style=\"text-align: justify;\">Opravy byt\u016f zaji\u0161\u0165uje BD prost\u0159ednictv\u00edm spr\u00e1vcovsk\u00e9 firmy, kter\u00e1 tyto opravy prov\u00e1d\u00ed z\u00e1klad\u011b po\u017eadavku\u00a0 u\u017eivatele bytu. Zaji\u0161t\u011bn\u00ed oprav si mohou\u00a0 u\u017eivatel\u00e9 zajistit\u00a0 tak\u00e9 samostatn\u011b prost\u0159ednictv\u00edm t\u0159et\u00edch osob, kter\u00e9 jsou k oprav\u00e1m zp\u016fsobil\u00ed v souladu s ustanoven\u00edm\u00a0 z\u00e1kona\u00a0 \u010d. 451\/91 Sb. o \u017eivnostensk\u00e9m podnik\u00e1n\u00ed, ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f. U jednoduch\u00fdch oprav je mo\u017en\u00e9 jejich proveden\u00ed sv\u00e9pomoc\u00ed.<\/li>\n<li style=\"text-align: justify;\">Proveden\u00e9 opravy v bytech jsou nevratn\u00e9 a z\u016fst\u00e1vaj\u00ed v byt\u011b i po p\u0159\u00edpadn\u00e9m p\u0159evodu \u010dlensk\u00fdch pr\u00e1v k bytu.<\/li>\n<li style=\"text-align: justify;\">K proveden\u00ed oprav v byt\u011b je t\u0159eba souhlasu BD. Pokud u\u017eivatel provede opravu bez souhlasu BD, m\u016f\u017ee p\u0159edstavenstvo rozhodnout o uveden\u00ed bytu do p\u016fvodn\u00edho stavu.<\/li>\n<li style=\"text-align: justify;\">\u017d\u00e1dost o povolen\u00ed proveden\u00ed opravy bytu p\u0159edkl\u00e1d\u00e1 u\u017eivatel p\u0159edstavenstvu BD spolu s technickou dokumentac\u00ed, tzn. v\u00fdkresy p\u016fvodn\u00edho a pl\u00e1novan\u00e9ho stavu, pokud je p\u0159edm\u011btem opravy stavebn\u00ed konstrukce bytu, zm\u011bna elektroinstalace, rozvodu plynu v byt\u011b, z\u00e1sah do otopn\u00e9ho syst\u00e9mu v byt\u011b, z\u00e1sah do rozvod\u016f studen\u00e9 a tepl\u00e9 u\u017eitkov\u00e9 vody. Spolu s uvedenou dokumentac\u00ed p\u0159edlo\u017e\u00ed i \u017eivnostensk\u00e9 listy \u010di jin\u00e1 opr\u00e1vn\u011bn\u00ed firmy, kter\u00e1 stavebn\u00ed \u00fapravy prov\u00e1d\u00ed.<\/li>\n<li style=\"text-align: justify;\">P\u0159edstavenstvo BD je povinno se k \u017e\u00e1dosti vyj\u00e1d\u0159it nejpozd\u011bji do 14 dn\u016f od jej\u00edho doru\u010den\u00ed.<\/li>\n<li style=\"text-align: justify;\">Pokud p\u0159edstavenstvo BD vyd\u00e1 u\u017eivateli povolen\u00ed k proveden\u00ed oprav, zve\u0159ejn\u00ed ho na n\u00e1st\u011bnce BD.<\/li>\n<li style=\"text-align: justify;\">Opravu m\u016f\u017ee u\u017eivatel, vlastn\u00edk zah\u00e1jit po vyd\u00e1n\u00ed povolen\u00ed p\u0159edstavenstva BD nebo po nabyt\u00ed \u00fa\u010dinnosti stavebn\u00edho ohl\u00e1\u0161en\u00ed, stavebn\u00edho povolen\u00ed.<\/li>\n<li style=\"text-align: justify;\">Proti nesouhlasu s podanou \u017e\u00e1dost\u00ed se m\u016f\u017ee \u017eadatel odvolat. Nesouhlas m\u00e1 v\u0161ak odkladn\u00fd \u00fa\u010dinek pro zah\u00e1jen\u00ed po\u017eadovan\u00e9 opravy.<\/li>\n<li style=\"text-align: justify;\">Po ukon\u010den\u00ed rekonstrukce budou p\u0159edstavenstvu BD p\u0159edlo\u017eeny souvisej\u00edc\u00ed dokumenty jako nap\u0159. revizn\u00ed zpr\u00e1vy (elektro, plyn) a technick\u00e1 dokumentace fakticky realizovan\u00e9ho stavu.<\/li>\n<li style=\"text-align: justify;\">Pokud p\u0159edstavenstvo BD po proveden\u00e9 oprav\u011b (oprava bez nutnosti stavebn\u00edho ohl\u00e1\u0161en\u00ed nebo na stavebn\u00ed ohl\u00e1\u0161en\u00ed) zjist\u00ed z\u00e1va\u017en\u00e9 odchylky od projektu,\u00a0 rozhodne dle jej\u00ed z\u00e1va\u017enosti o sjedn\u00e1n\u00ed n\u00e1pravy.<\/li>\n<li style=\"text-align: justify;\">Ukon\u010den\u00ed opravy kolaudac\u00ed podl\u00e9h\u00e1 pravomoci stavebn\u00edho \u00fa\u0159adu.<\/li>\n<li style=\"text-align: justify;\">Dokumentace o oprav\u011b v byt\u011b se archivuje v dokumentaci domu.<\/li>\n<li style=\"text-align: justify;\">Pokud by v d\u016fsledku prov\u00e1d\u011bn\u00e9 opravy vznikla jak\u00e1koliv \u0161koda na majetku BD nebo dal\u0161\u00edch fyzick\u00fdch osob v dom\u011b, je u\u017eivatel, prov\u00e1d\u011bj\u00edc\u00ed opravu za zp\u016fsobenou \u0161kodu pln\u011b odpov\u011bdn\u00fd.<\/li>\n<li style=\"text-align: justify;\">Opravy byt\u016f mohou b\u00fdt prov\u00e1d\u011bny v pracovn\u00edch dnech a v sobotu od 8,00 do 20,00 hodin a u\u017eivatel mus\u00ed pr\u016fb\u011b\u017en\u011b prov\u00e1d\u011bt \u00faklid spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu, zne\u010di\u0161t\u011bn\u00fdch v d\u016fsledku prov\u00e1d\u011bn\u00fdch oprav a zajistit likvidaci odpadu.<\/li>\n<\/ol>\n<h3>IV.\u00a0 Financov\u00e1n\u00ed oprav byt\u016f<\/h3>\n<ol>\n<li style=\"text-align: justify;\">Zdrojem pro financov\u00e1n\u00ed oprav byt\u016f jsou finan\u010dn\u00ed prost\u0159edky u\u017eivatel\u016f nebo vlastn\u00edk\u016f.<\/li>\n<li style=\"text-align: justify;\">Zdrojem pro financov\u00e1n\u00ed oprav byt\u016f mohou b\u00fdt i p\u0159\u00edsp\u011bvky st\u00e1tu u\u017eivatel\u016fm nebo vlastn\u00edk\u016fm dle zvl\u00e1\u0161tn\u00edch p\u0159edpis\u016f (nap\u0159. na\u0159\u00edzen\u00ed vl\u00e1dy \u010d. 28\/2006 Sb. o podm\u00ednk\u00e1ch pou\u017eit\u00ed finan\u010dn\u00edch prost\u0159edk\u016f SFRB formou \u00fav\u011bru ke kryt\u00ed \u010d\u00e1sti n\u00e1klad\u016f spojen\u00fdch s modernizac\u00ed byt\u016f\u00a0 n\u011bkter\u00fdmi osobami mlad\u0161\u00edmi 36 let).<\/li>\n<\/ol>\n<h3>VII. Z\u00e1v\u011bre\u010dn\u00e1 ustanoven\u00ed<\/h3>\n<ol>\n<li style=\"text-align: justify;\">Sm\u011brnice byla schv\u00e1lena na jedn\u00e1n\u00ed p\u0159edstavenstva BD dne 12.10. 2007 a nab\u00fdv\u00e1 \u00fa\u010dinnosti dnem schv\u00e1len\u00ed.<\/li>\n<\/ol>\n<p>V Praze dne 12.10. 2007\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ing.
